The holder accepts the terms and conditions of the LSA – My Zone program as well as the conditions of use provided on the Laberge – services alimentaires inc. website (www.weblaberge.com). No refund is applicable. In the case of loss or theft, the available balance shall be transferred to a new card (a $5 fee shall be levied).
Terms and conditions of the LSA – My Zone program
The term “member” hereunder means a client of LSA who is registered in the LSA – My Zone program and whose registration has not been revoked, whereas “LSA” designates Laberge – services alimentaires inc. Unless otherwise provided, the singular includes the plural and the masculine gender includes the feminine.
- LSA can at any time amend the terms and conditions as well as the components of its program. The terms and conditions as well as their amendments and updates are posted on the www.weblaberge.com website without other formality or prior notice to members. The full and current version posted on www.weblaberge.com shall prevail over any other version and members are responsible for visiting this website regularly to consult any modifications that may have been made. The member’s continued participation in the program as modified shall be construed as his consent to the modifications made. If the member does not consent to a modification, he may elect to withdraw from the program pursuant to the “Voluntary withdrawal from the program” section.
- Term. The program comes into effect on the date it is launched, and LSA reserves the right to terminate it at any time without other formality. In the event of termination, members shall dispose of thirty (30) days from the date of the advance notice to use the accumulated balance in their account. After this 30-day period, the unused balance of each member’s account shall be cancelled without compensation or recourse. Member status shall automatically be cancelled in the event of termination.
- Terms and conditions of registration. Registration is free, but an initial $50 purchase is required. To join the program, the LSA client must follow the registration process, provide complete and accurate information and confirm his acceptance of these terms and conditions.
- The card remains the property of LSA and can be revoked at any time at LSA’s sole discretion. At the time of registering, if the member opted to have two (2) cards issued to his account, he accepts responsibility for the transactions made as part of the program. He is also responsible and accountable for all actions and transactions made by the cardholder. Only the member shall be authorized to request, through the administrative centre’s customer service department, that LSA deactivate a card and/or close the LSA – My Zone account. It is possible to transfer, share or assign a balance between two (2) cardholders or more, namely in the case where the member’s account is closed. However, no reimbursement can be issued.
- The LSA – My Zone program is available at LSA’s participating branches and points of sale as well as from partners designated and authorized by LSA, as determined by LSA from time to time (hereinafter the “authorized points of sale”).
- For the purposes of invoicing and the collection of the specific tax by LSA on behalf of government authorities, the specific tax that is billed and paid by the client on product purchases is that set from time to time by the law and applicable regulations, depending on product nature and/or category. The specific tax rate shall be calculated on all products and services purchased at points of sale or through the www.weblaberge.com/boutique transactional website. The specific tax rate may vary from time to time.
- LSA may propose from time to time, without however being obliged to do so, personalized promotions to members, based among other things on their respective purchases, preferences and profiles. A personalized promotion is valid only for the member to whom it is proposed and is subject to applicable terms and conditions. The rules and conditions applying to such promotions as well as necessary corrective notices are posted on the www.weblaberge.com website as well as in participating points of sale and shall prevail over any other mode of communication or posting in the event of conflicting interpretations.
- A member may redeem the balance of points in his account to pay the whole or part of his purchases of eligible products and services made at participating authorized points of sale as described below. To do so, the member shall be required to present his card prior to the completion of the transaction, in accordance with LSA’s instructions. To ensure that the points are indeed redeemed by the member himself to purchase products or services, LSA reserves the right to ask for a proof of identity from the person.
- If a member believes that an error was made on his invoice, he must inform LSA thereof within two days (2) of the date indicated on the invoice. To request an adjustment or a correction, the member must provide the necessary supporting documents to LSA’s satisfaction. LSA shall solely determine whether the request is justified or not. The balance indicated on the invoice and/or the communications sent to the member may not necessarily be identical to the current balance of points in the member’s account. Should the member disagree with the number of points accumulated, used or deducted from his account, the data kept in LSA’s records shall prevail. LSA declines any and all responsibility for errors in the balance indicated on the invoice, in the member’s account and/or in communications sent to the member. LSA may deduct at any time and without prior notice balances credited by error to a member’s account. LSA is under no obligation to honour a request to apply points credited to an account by error. LSA shall not be held responsible for errors that may arise in the issue or delayed issue or receipt of promotional offers to/by the member as well as for the non-receipt of such offers. The member may not sell, purchase, assign and/or otherwise transfer the whole or part of the balances to another party.
- Lost and stolen cards, etc. In the case of loss or theft of the member’s LSA – My Zone card, the member must immediately notify LSA thereof. Once duly notified of the loss or theft of a member’s card, LSA shall deactivate said card in the member’s account and activate the new card obtained by the member from a participating branch. A member who loses his password is responsible for immediately requesting a new password through the www.weblaberge.com website. LSA cannot be held responsible for the use of account balances and transactions between the time a card is lost or stolen (or the account’s user name and password are compromised) and the time LSA is informed thereof. A fee of five (5) dollars shall be levied by LSA when a card is replaced at a member’s request.
- Obligation for the member to keep his file up to date. The member represents and warrants that the information he provides to LSA is accurate. Also, the member shall be responsible for updating his personal information and account profiles when necessary.
- Voluntary withdrawal from the program. A member may choose to withdraw from the program at any time by making a request through the website. When a member makes such a request, the member’s LSA – My Zone account is immediately closed and his accesses are revoked, his member cards are immediately deactivated and his account points are cancelled, without other formality or compensation. Once his account has been closed, a client who wishes to rejoin the program shall be required to re-register. In such a case, the balances accumulated immediately before the account was closed cannot be recuperated and the account cannot be reactivated. In the event of a member’s death, the member’s account is closed and the account balance is donated to a charitable cause.
- Closure of an inactive LSA – My Zone account. Except as hereby provided, balances do not expire. However, if a member’s account remains inactive during a two (2)-year period, it shall be closed, access to the account shall be revoked and all points accumulated in the account shall be immediately cancelled on expiry of said period of two (2) years, without prior notice to the member or formality. To maintain an active account and registration in the program, the member is therefore required to accumulate or use point balances at least one every two (2) years or be otherwise active in the program.
- LSA may hold contests as part of the program. Eligibility conditions relative to members’ place of residence and other criteria may apply to said contests. LSA thereby reserves the right to limit the eligibility to enter certain contests only to members who meet the conditions and criteria of each respective contest (e.g., place of residence, purchase requirements, etc.). LSA employees as well as persons with whom they are domiciled are not eligible to enter program contests. In the event where entry in a contest is automatic as part of a purchase, promotion, event and/or activity in which the member takes part, the member shall however be required to meet all of the applicable conditions and consent to the contest rules and regulations, namely to claim his right to participate in said contest as well as contest prizes and benefits, if applicable. The rules and regulations of each program contest shall be posted on the www.weblaberge.com website.
- Applicable law. These terms and conditions are governed by the laws applicable in the province of Québec.
- Consent to communications. By registering in the program, the member consents to receiving electronic communications related to the program. Furthermore, subject to his consent pursuant to applicable laws, the member consents to receiving electronic communications on LSA’s services, products, contests, events, and promotions. At any time, the member may elect to withdraw his consent to receiving such promotional communications by accessing the communication preferences section of his LSA – My Zone account.
- By registering in the program, by using his card, his member number or another authorized identification support, by opening a session to access his LSA – My Zone account or by accumulating points or otherwise participating in the program, each member (and each second cardholder, if applicable) acknowledges having read and understood these terms and conditions as well as the confidentiality policy and agrees to be bound by them, as they may be amended from time to time. The member (and the second cardholder, if applicable) hereby authorizes LSA to collect, analyze, use and retain his personal information as well as information on his tastes, preferences, purchase transactions and browsing habits on LSA websites in accordance with the commitments made by LSA in its confidentiality policy. Furthermore, pursuant to the program and for management and administration purposes, the member authorizes LSA to disclose certain personal information to its suppliers and authorized partners, subject to their respective commitments with respect to confidentiality. As part of the program and its business activities, LSA could otherwise dispose of the data and information collected on the member at its discretion, subject to refraining from disclosing any personal information to third parties and to protecting the confidentiality and security of all personal information collected.
- Official version. The French version of these program terms and conditions is the official version and prevails over the version translated into English.
